CVLAYER - User Agreement and Terms of Use
This User Agreement (“Agreement”) is entered into between Ömer Engin ÖZ (“Company”), the sole owner of https://cvlayer.com (“Platform”), and the legal or natural person (“User”) who registers, uses, or purchases services on the Platform. By registering or using the Platform, the User confirms they have read, understood, and accepted this Agreement in its entirety.
CVLayer is a cloud-based software service (SaaS) that enables Users to manage recruitment processes, provides video interview infrastructure, and generates candidate evaluation reports through natural language processing (NLP) and AI technologies. CVLayer is not an employment agency; it provides only technical infrastructure and data analysis tools.
3.1. Account Security
The User is obligated to keep account credentials confidential. Transferring, renting, or sharing accounts with other individuals or entities is strictly prohibited.
3.2. Legal Compliance and Data Protection Responsibility
The User (Recruiting Agency/Company) is the “Data Controller” responsible for complying with KVKK and applicable regulations when processing candidate personal data. The User is solely responsible for obtaining required informed consent and explicit consent from candidates for video recording, AI analysis, and data transfer. CVLayer shall not be held liable for any legal or criminal sanctions arising from breach of this obligation.
3.3. Prohibition of Misuse
The User may not reverse-engineer the Platform's infrastructure or APIs, use bots or automation scripts to exceed AI analysis quotas, or engage in activities threatening system security. Upon detection, the Company reserves the right to unilaterally terminate the account without refund.
4.1. Advisory Status
Candidate scores, CV analyses, sentiment reports, and job listing optimizations provided by CVLayer are advisory outputs generated by machine learning algorithms and third-party AI service providers.
4.2. Decision-Making Responsibility
Final hiring, interview evaluation, and candidate selection decisions are entirely at the User's discretion. CVLayer shall not be held liable for the outcomes of hiring decisions made based on AI analyses.
4.3. Infrastructure and Downtime
The Platform is provided “as-is”. The Company is not responsible for indirect or direct business losses arising from server outages, data delays, or API interruptions caused by third-party providers such as AWS, OpenAI, or Dyte.
All intellectual and industrial property rights to the Platform's design, software, algorithms, databases, and generated report formats are exclusively owned by the Company. The User retains ownership of their uploaded data (e.g., candidate CVs); however, the User grants the Company a royalty-free license to process such data for service delivery, AI analysis, and anonymized system improvement.
The User may cancel their subscription at any time. The Company may unilaterally terminate the Agreement and immediately suspend access without prior notice in case of breach of terms, failure to fulfill payment obligations, or illegal use of the Platform.
The laws of the Republic of Turkey shall apply to any disputes arising from the interpretation or performance of this Agreement. İzmir Courts and Enforcement Offices shall have jurisdiction.
